FAQs

Is shift differential pay mandatory by law?

In the US, the Fair Labor Standards Act (FLSA) does not require shift differentials — it is a matter of employer policy or union agreement. However, shift differential pay IS included when calculating overtime. If you earn a differential and work over 40 hours, your overtime rate must be based on your blended (regular + differential) pay rate.

What is a typical shift differential percentage?

Evening shift differentials are typically 5–10% above base pay. Night shift differentials run 10–15%, and some industries (healthcare, manufacturing) offer up to 20–25% for overnight or weekend shifts. Holiday differentials often run 1.5x to 2x base pay. These are employer-set and vary widely by industry.

Is shift differential pay taxed differently?

No. Shift differential pay is treated as regular wages for tax purposes. It is added to your total gross pay and taxed at your marginal income tax rate. It is also subject to Social Security and Medicare (FICA) taxes.

How does a union shift differential work vs a non-union one?

Union shift differentials are negotiated through collective bargaining and written into the collective agreement — they are legally binding and typically more generous. Non-union differentials are set by employer policy and can be changed with notice.

Does shift differential count toward overtime calculation?

Yes. In the US, the FLSA requires that overtime (1.5x) be calculated on the regular rate of pay, which includes shift differentials. So if your effective blended rate including differential is $22/hr, your overtime rate is $33/hr — not $30/hr based on base pay only.
